Terms & Conditions

OneSongAway

By accessing or using the OneSongAway website and services, you agree to the following Terms & Conditions. Please read them carefully before placing an order.

1. About Our Service

OneSongAway creates custom-made songs based on the information provided by the customer through our forms. Each song is uniquely crafted and personalised according to the selected plan.

Due to the creative and personalised nature of our work, all orders are handled with care and intention.

2. Payment & Order Confirmation

To confirm your order and initiate production, full payment is required in advance.

Immediate Start

Once the payment is received and your customization form is submitted, our team begins the creative process immediately.

No Cancellations

Due to the personalized and labor-intensive nature of our service, the payment is non-refundable once production has commenced.

Delivery

The final song will be delivered to the contact details provided in your order form upon completion.

3. Refund & Cancellation Policy

  • No refunds are applicable once the production process has started.
  • Since each song is custom-created, cancellations after production begins are not eligible for refunds.
  • If an order is cancelled before production starts, any refund (if applicable) will be evaluated at our discretion.

4. Revisions Policy

Revision allowances depend on the plan selected:

  • Mini Custom: No free lyric revisions
  • Together: 1 free lyric revision
  • Forever: 2 free lyric revisions

Important notes:

  • Revisions apply only to lyrics, not to the final produced song.
  • Once lyrics are finalised and song production begins, no changes or rework will be accepted.
  • Additional lyric revisions beyond the plan allowance are available at an extra cost of ₹999 per revision.
  • Partial adjustments may be considered; however, major changes may require a new order.

5. Production & Final Delivery

Once your order is confirmed and production is complete, the final song will be sent directly to you.

Direct Delivery

The final high-quality song files will be delivered to the contact details provided in your order (Email/WhatsApp).

Final Sale

We do not share intermediate previews or drafts. Due to the custom artistic nature of our service, the delivered song is considered final. No changes, rework, or re-production can be requested once the song has been delivered.

6. Delivery Timelines

Delivery timelines vary based on the selected plan and are communicated clearly at the time of order.

Delays may occur due to:

  • Late responses or incomplete information from the customer
  • Requested changes or revisions
  • Technical or unforeseen production issues

Such delays will not be considered a breach of service.

7. Intellectual Property & Co-Creation

7.1 Co-Creation

We recognize that every song is a unique collaboration ("Co-created") based on the stories, memories, and inputs provided by You (the Client).

7.2 Ownership

To ensure we can protect the work and manage its distribution effectively, OneSongAway retains full legal ownership, copyright, and intellectual property rights to the final musical composition, lyrics, and master recording.

7.3 Client License

Upon full payment, OneSongAway grants You a perpetual, non-exclusive, worldwide, royalty-free license to use the song for personal, non-commercial purposes. This includes:

  • Sharing the song on social media (Instagram, YouTube, TikTok, etc.).
  • Using the song in personal videos (e.g., wedding films, birthday montages).
  • Playing the song at private events.

8. Optional Digital Distribution (Spotify, Apple Music, etc.)

8.1 Opt-In Service

During the order process, You may elect to have Your custom song distributed to commercial streaming platforms (e.g., Spotify, Apple Music). This service is performed strictly on an "On-Demand" basis.

8.2 Administration

If You select "Yes" for distribution, You authorize OneSongAway to act as the exclusive administrator of the recording on all Digital Service Providers (DSPs). You agree not to upload the song to these platforms yourself, as this creates a copyright conflict.

8.3 Revenue & Royalties

You acknowledge that the fee paid to OneSongAway covers the production and service costs only. You are not entitled to any share of royalties, streaming revenue, or performance rights income generated by the song. All backend revenue remains the sole property of OneSongAway to cover ongoing distribution, server maintenance, and administrative costs.

8.4 Revocation (Takedown Policy)

You may request the removal of Your song from streaming platforms at any time. To do so, please email support@onesongaway.com with your Order ID. We will initiate the takedown process within 7 business days. Please note that streaming services may take an additional 2-4 weeks to fully remove the content from their public libraries.

9. Content Guidelines

Requests containing offensive, illegal, harmful, or inappropriate content may be declined.

10. Communication

  • Communication will primarily take place via email or Instagram DMs.
  • Customers are responsible for providing accurate contact details.

11. Limitation of Liability

OneSongAway is not responsible for subjective dissatisfaction, third-party technical issues, or delays beyond reasonable control.

12. Governing Law

These Terms & Conditions are governed by the laws of India.

OneSongAway reserves the right to update these terms at any time.
